Terms & Conditions — SunCasa Barcelona Edition

These Terms & Conditions (“Terms”) govern your application to and participation in the SunCasa Barcelona Creator Retreat (“Retreat”), operated by SunCasa Retreats (“SunCasa”, “we”, “our”, “us”). By submitting an application, placing any deposit, making any payment, or attending, you agree to these Terms.
1. Eligibility
- You are at least 18 years old.
- You can lawfully enter Spain as a visitor and will obtain any required travel documents (passport/visa).
- You will follow house rules, local laws, and reasonable organizer instructions.
2. Applications & Selection
- Applications are reviewed for fit, availability, and overall group balance.
- Submitting an application does not guarantee acceptance.
- We may decline an application at our discretion (for example: capacity limits, safety concerns, or inability to comply with house rules).
- We cannot guarantee the attendance of any specific participant. Your booking is for participation in the Retreat as a whole, not for collaboration with any particular individual.
3. Payments
- Optional priority deposit: You may choose to place a $200 USD deposit. If you are invited and you attend, this deposit is credited toward your total. (If you do not place a deposit, you can still be considered.)
- Invitation & payment: If accepted, you will receive an invitation email with a private payment link or invoice and a deadline to confirm your spot.
- Failure to pay on time: If you do not pay by the stated deadline, your spot may be released to another applicant.
- Pricing: Published pricing is shown on the website and may vary by room type and availability. Unless stated otherwise, flights, transfers, and personal expenses are not included.
- Room type: Room preferences (single/shared) are honored where possible but not guaranteed until final assignment.
- Currency/fees: Charges are in USD unless stated otherwise. Bank/FX or card fees are your responsibility.
3.1 Cancellations & Refunds
Because this is a small, curated retreat with limited capacity, our cancellation policy is strict.
- Optional deposit: If you placed a deposit and you are not invited, or you decide not to proceed before paying the full balance, you may request a refund of the deposit (unless otherwise stated in writing).
- After full payment: Once the retreat balance is paid, cancellations are generally non-refundable. Refunds may be granted only in Exceptional Circumstances(for example: documented serious illness, bereavement, or visa refusal), at our discretion.
- Replacement option: If you cannot attend, we may allow a replacement at our discretion. If a qualified replacement is approved and fully pays, we will refund the amount we are able to recover, minus any administrative/processing costs.
- Operator cancellation: If we cancel for reasons other than your breach, you will receive a refund of amounts paid to SunCasa. We are not responsible for third-party costs such as airfare, accommodation outside the Retreat, or visa fees.

3.2 Chargebacks & Payment Security
- Payments may be processed via Stripe or another provider specified at checkout. Unauthorized or unfounded chargebacks may be contested with evidence (e.g., application records, invoices, check-in records).
- Initiating a chargeback does not void these Terms. If a chargeback is reversed in our favor, you remain responsible for any processor dispute fees.
3.3 Late Arrival / Early Departure
- Arriving late or leaving early does not create eligibility for refunds or credits.
4. House Rules / Code of Conduct
To keep the environment safe, productive, and respectful, all participants agree to the following. Repeated or serious violations may result in removal without refund.
- Respect & consent: Obtain explicit consent before filming someone or including them in content. Consent may be withdrawn at any time.
- Privacy:No hidden cameras or secret recording.
- Shared spaces: We may manage schedules for common areas to keep access fair.
- Noise & neighbors: Follow quiet hours and local rules. Serious complaints may lead to removal.
- Cleanliness & damage: Maintain shared areas and clean up after shoots. You are financially responsible for damage you cause.
- Alcohol/drugs: Legal, moderate use only. No illegal substances. Behavior that endangers safety or disrupts the group is grounds for removal.
- No harassment: Zero tolerance for harassment, abuse, hate speech, or discrimination.
- Removal examples: threats, violence, property damage, filming without consent, illegal activity, or refusal to comply with reasonable instructions.
5. Content, IP & Publicity
- Not a production company: SunCasa is not a studio, agent, producer, manager, or employer. You are responsible for your own releases, contracts, and platform compliance.
- Your content: You own the content you create and are responsible for its legality and compliance.
- Use of SunCasa name/marks: You may truthfully reference attendance (e.g., “Shot at SunCasa Barcelona”). Do not imply endorsement without written permission.
- Organizer media: We may capture general, non-sensitive photos/video of common activities (e.g., group meals) for marketing. You can request a “no-photo” status at or before check-in; we’ll use reasonable efforts to exclude you from collateral.
6. Liability & Disclaimers
- Participation is voluntary: You may decline any activity or collaboration at any time.
- Health & self-care: You are responsible for your own well-being, medication, and known conditions/allergies.
- Travel disruptions: We are not responsible for missed flights, delays, visa issues, cancellations, illness, or no-shows.
- Third-party acts: SunCasa is not responsible for actions/omissions of other participants, vendors, or platforms.
- Loss/damage: We are not liable for lost, stolen, or damaged personal items. You are liable for damage you cause.
- Max liability: To the fullest extent permitted by law, our aggregate liability is limited to the amounts you paid to SunCasa for the Retreat giving rise to the claim.
- No guarantees: We do not guarantee specific business outcomes, follower growth, or revenue results.
7. Safety, Emergencies & Removal
- Provide an emergency contact during application and keep it up to date.
- We may remove any participant who endangers safety, seriously disrupts the group, violates law, or breaches these Terms. No refunds apply in case of removal for breach.
8. Privacy & Data
We process your data as described in our Privacy Policy. By applying or attending, you acknowledge that policy.
9. Program Changes & Force Majeure
- Itinerary/facility changes: We may make reasonable changes to schedules, activities, or the villa due to availability or operational needs, providing comparable alternatives where possible.
- Force majeure: We are not liable for delays or cancellations caused by events beyond our control (e.g., severe weather, strikes, pandemics, government actions). If affected, we’ll work in good faith on reasonable remedies (date change, credits, or partial refunds of recoverable costs).
10. Governing Law & Venue
These Terms are governed by the laws of Spain without regard to conflict-of-law principles. Exclusive venue for disputes shall be the competent courts in Barcelona, Spain, unless otherwise required by applicable consumer-protection law.
11. Informal Resolution
Before filing any claim, the parties will attempt good-faith informal resolution by emailing contact@suncasa.space with the subject “Dispute — Barcelona Retreat.” If unresolved after 30 days, either party may pursue remedies in the venue above.
12. Miscellaneous
- Severability: If any provision is unenforceable, the remainder stays in effect.
- No waiver: Failure to enforce a provision is not a waiver of the right to do so later.
- Assignment: You may not assign your participation without our written consent.
- Entire agreement: These Terms plus your invitation/payment confirmation and house rules constitute the entire agreement regarding the Retreat.
13. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date reflects the latest version. Material changes will be communicated to confirmed participants by email.
